Authors: Wang Xiangxiu, Chen Xiaowei

Abstract: The outbreak of the China-US trade war is closely related to differences in the two countries’ intellectual property legal systems. In order to promote friendly cooperation, China and the United States signed the China-US Economic and Trade Agreement upon consultation and negotiation. The China-US Economic and Trade Agreement includes detailed provisions on intellectual property protection, including trade secrets, pharmaceutical patents, patent protection, and ecommerce platforms. A thorough study of its provisions on intellectual property rights is very significant for improving China’s rule of law of intellectual property. Based on the content of the China-US Economic and Trade Agreement and in light of China’s intellectual property rule of law status quo, the impact of the signing of the China-US Economic and Trade Agreement is analyzed based on intellectual property protection in China involving trade secrets, pharmaceuticals, patents, and e- commerce platforms. The perfection of China’ s intellectual property rule of law should be approached in terms of three aspects: perfecting legislation, enforcing the law, and strengthening the judicature.
