Author: Cui Kaiwei

Abstract: Faced with the fragmentation of international commercial rules and disorderly competition in the supply of relevant institutions, the theory of public goods supply provides a new idea for promoting legal innovation within the Belt and Road Initiative. It requires that the principle of “co-construction” be followed; it also resists exclusive and malicious competition in the realization of product offerings. In order to solve the problems of biased use of public goods, insufficient income and worsening competition, and escalate the ability of the rules of international commercial laws of the Belt and Road Initiative, it is necessary to cooperate with international organizations, such as the UN, UNIDROIT, and ICC, to continuously expand the application of International Uniform Commercial Law in China, and contribute institutional public products with co-construction characteristics. Specifically, we could clarify the functions of the Belt and Road Initiative’s soft law, focus on financial integration and infrastructure positioning, enrich and innovate the provisions of the international commercial legal system, and further optimize the Belt and Road Initiative’s commercial dispute settlement mechanism to highlight the advantages of the Belt and Road Initiative in supplying public goods.
