Title:The Identity Coordination between Public Body and Government Procuring Entity from the Perspective of State-owned Enterprises

Author:Yuchen Tang

Abstract:Government procuring entities in the Government Procurement Agreement and the public bodies in the Agreement on Subsidies and Countervailing Measures are two different system entities, but on the issue of state-owned enterprises (SOEs), they may have some degree of overlapping identity that blurs the differences between SOE market player and government policy tool. An analysis of the governmental nature and market nature of SOEs shows that the core characteristic of the governmental nature of SOEs is the organic combination of government control, governmental purpose and governmental function. As to the subject, public body and government procuring entity respectively reflect the governmental nature of SOEs while exhibiting similarities. As to the behavior itself, subsidy and government procurement are interconnectable, where gaps and exemptions exist in international regulations. The scope of the procuring entity list is based on the SOE classification system, and the subsidy behavior by the public body of SOE is converted to government procurement behavior, which tends to resolve the overlapping identity of SOEs within the Government Procurement Agreement and the Agreement on Subsidies and Countervailing Measures.
